Is it possible to buy an apartment or a house by proxy? Yes, it is possible. More details about what you need for this and how the entire sales process goes are described below:

If you want to buy real estate in Munich / Germany, but cannot be present at the conclusion of the purchase and sale transaction, our real estate agent will help you make the purchase remotely, without coming to the country. We or you look for real estate to buy. Under your general power of attorney, we act for you at the notary when signing the purchase and sale agreement. We will take care of the further execution of the transaction and all subsequent payments.

In order to represent your interests when purchasing real estate, you need to have a general power of attorney issued to a notary to complete the transaction. You also need to have your power of attorney certified with an apostille by the Ministry of Justice in your country. If you have issued a general power of attorney in Germany, then certification with an apostille is not necessary. After certification with an apostille, you need to have it translated into German by a sworn translator who has this title and the appropriate seal for documents. Based on this translated document, we will be able, as a full representative, to conduct transactions without your presence. In the future, the power of attorney will be transferred to the notary who draws up the agreement. At your request, the translation of the power of attorney certified with an apostille can also be done in Germany by our partners.

Step-by-step scheme and subtleties of purchasing real estate by proxy:

  1. You decide on the object of purchase. Perhaps you yourself or we will push the necessary object to you.
  2. Registration of a notarized power of attorney in your country and additionally certified with an apostille. The apostille is made at the Ministry of Justice. Here, a clear formulation is also needed that it is you who decides what object you want to purchase, and authorizes your representative to purchase it.
  3. You must translate this power of attorney with an apostille into German, and by a sworn translator (this is also important)!
  4. Now it’s up to the realtor and the German notary. So all real estate transactions in Germany are carried out only at the notary. As soon as the notary receives all the necessary documents, he draws up a preliminary purchase and sale agreement for review. We can translate this agreement for you and you can also make your own amendments. Purchase and sale agreements at the notary are standardized.
  5. After your consent, a meeting with a notary is scheduled to sign the contract. The contract is signed according to the executed power of attorney on your behalf. We send you the original signed contract by mail.
  6. A note is made in the land register (cadastral register) about the preliminary entry of a new owner until the full payment of the property price under the contract (Auflassungsvormerkung). This is done so that the seller cannot sell or dispose of the property until you have paid all expenses and become the new owner.
  7. Now that the transaction has been notarized, the buyer must transfer the full amount for the property by bank transfer in accordance with the agreement.
  8. At the same time, a property purchase tax of 3.5% is paid in Bavaria/Munich (the notary receives confirmation from the tax office – Unbedenklichkeitsbescheinigung). Only then are you entered as the new owner in the land register.
  9. As soon as you are entered in the land register, you become the owner of the property. You receive an up-to-date extract from the land register from the notary.
